POSITION:  Paralegal/Land Specialist

 

LOCATION:  Red Cliff Reservation, Tribal Court House

 

SALARY:  Negotiable depending upon qualifications

 

THIS IS A REGULAR FULL-TIME NON EXEMPT POSITION

 

SUPERVISOR(S):  Tribal Attorney

 

JOB SUMMARY:  The primary responsibility will be spent on land issues, leases, research of titles, and environmental issues with land.  Serve as guardian ad  litem.

           

DUTIES AND RESPONSIBILITIES:  The person hired will be responsible to the Tribal Attorney.  Majority of time will be spent on land issues, including, but not limited to, accepting and processing all land requests, drafting and enforcing lease agreements; rent collection; maintain land-use related files; research claim on title issues and concerns; recommend selection of tenant(s); handle all land acquisitions (fee to trust, for tribe and individuals); assist in environmental assessments regarding land issues.  You will e involved with zoning and land uses, including designation of location of roads, assist in drafting of road regulations assist B.I.A. in regard to roads and land leases.  You may be also asked to provide legal research requested by the Tribe; serve as guardian at litem; draft pleadings, including proposed judgments and orders as directed by Tribal judges; draft resolutions, proposed ordinances and amendments; maintain files; and perform other duties as assigned. Work closely with BIA staff to effect federal approval of Tribal leases and land issues.

           

SUPERVISORY AUTHORITY:  None

 

KNOWLEDGE:  Knowledge of Tribal Government and Court and its system of delivery.

 

QUALIFICATIONS:  Prefer an individual who has completed a certified paralegal training program.  High School diploma or equivalency required.  Applicant must have some post-secondary education or work experience in this field or a related field.  Must have a valid driver’s license, vehicle and insurance.  If no insurance must get within three weeks of employment.  Have demonstrated capability to identify legal issues and have good knowledge of legal research and writing techniques.  Must submit an original writing sample analyzing the questions posed on the attached sheet.  (Tribal Court Library is available for use.)  Applicants who do not submit both the writing and an application will not be considered for the position.  Have knowledge of the Tribal Court and its system of delivery.  Must become a member of the Red Cliff Court Bar within 90 days of hiring.  Native American preferred but all applicants will be considered.

 

PERSONAL CONTACTS:  Daily with legal staff, various program staff and community members.

 

PHYSICAL REQUIREMENTS: Mostly and office position which will require some bending and lifting and walking lease sites.

 

WORK ENVIRONMENT:  Mainly office position but may be required to visit various site locations on the reservation as needed.

 

TRAVEL REQUIREMENTS:  Will be required to attend meetings and trainings as directed.  Will travel to B.I.A. and within reservation as needed.

PARALEGAL WRITING SAMPLE

 

 

 

Answer both of the following questions.  For each question provide a list of sources you consulted so that the court may review them.

 

 

 

 

  1. As advocate for the Tribal Government, you are prosecuting a Tribal Member for parking an automobile so as to block the entrance to the ambulance garage, a violation of the Tribe’s traffic ordinance expressly prohibiting parking there.  The penalty provisions of the ordinance provides for a civil forfeiture only.  The defendant has asserted the defense that the Tribe has no authority to enact such an ordinance.  The court directs you as counsel for the plaintiff to respond by writing a brief in support of your position that the Tribe has the authority to enact the challenged traffic ordinance.  Write a brief persuading the court of your position, no longer than two (2) doubled spaced pages, if typed.

 

 

  1. Describe the lease application process from the time a person enters the office to the time the lease is finally granted.  List five reasons for termination of a lease and explain source.  Outline the process for termination of a lease.  Indicate all sources used in your research (i.e. statutes, manuals, agencies, etc.),
